To The Editor:
This letter is written in response to a recent letter from a writer who wrote saying “if it ain’t broke, don’t fix it” in support of our current domestic relations judge in Medina County. While I have always had a great deal of respect for this writer and usually find myself agreeing with him, I have to say, this time you missed the boat. My experience with the current domestic relations judge tells me the system is broken and in desperate need of of a change.
My case took well over four years in the court system to reach resolution and eventually had to have another judge brought in from outside the county. The Ninth District Court of Appeals found Judge Kovack’s determination of spousal support “excessive,” “unreasonable and inappropriate” and were “troubled by the combination of such high amount awarded until either party dies or appellee remarries,” and noted the court awarded more spousal support than was even requested. The finding that “the trial court did abuse its discretion in its award of spousal support” ended up costing the involved parties unnecessary time and money to resolve. Look up Farnsworth v. Yes, cases before the domestic court do involve a “great deal of anger, division of family relationships and hurt.” It is precisely for this reason that we must have a domestic relations judge whose judgement, temperament and rulings are fair and equitable to all parties involved. It is not the place for “excessive” and “troubling” rulings that “abuse the court’s discretion”
