A Merrillville man faces charges for allegedly shooting at his neighbor.

Donald W. Davis, 46, was charged Friday with attempted battery, criminal recklessness and two counts of intimidation

Merrillville Police were called 3:31 a.m. March 16 to the 600 block of E. 78th Lane for a shots fired call.

The victim told police he was at a local Jamaican restaurant for food and drinks earlier that evening with his relative when Davis showed.

When the man returned home, he noticed a white GMC Acadia pulled up from Davis’ home to his.

Two women in the vehicle said they were visiting another neighbor down the block, but pulled into Davis’ driveway when he came home in a black Corvette. They later went inside.

The victim said he “confronted” the women about “lying” to him.

The victim was on standing on his porch when Davis, in his own driveway, fired a shot at him, the victim said. He showed police some damage on his front porch.

Davis told officers through a security camera he got off work at 3 a.m. and wasn’t home when the shooting happened.

Officers found a .45-caliber bullet casing at the end of Davis’s driveway. Another officer found a bullet fragment in the victim’s garden, according to the affidavit.

Police got a search warrant for Davis’ home after he, the two women and a relative surrendered after the Tactical Apprehension Squad and Hostage and Crisis Negotiation Team showed.

Hey found a .45-caliber gun inside with six live rounds. They also found various bullets, a partially loaded gun magazine, a plastic bag with pink pills, Louis Vuitton bag, and iPhone.

Two handguns and a rifle were left, because they didn’t match the bullet shot.

The victim later admitted he was “buzzed” and got into an argument with one of the women, after he accused her of hitting Davis’ car. He said “disrespectful” things to the women, but didn’t “threaten” them, according to court records.

He alleged Davis was abusive toward them.

“Keep that weird (stuff) over there,” he allegedly told Davis.

The victim said he was standing on his porch when he heard a “boom”. Then, he started to go inside.

“Come outside, I’ll kill you,” Davis allegedly told the victim three times.

One of the women told police she and a friend had been at a club/bar in Gary’s Miller section when she met Davis and agreed to go back to his home.

The victim — the man that approached their vehicle — was “weird” and “rude”, but didn’t threaten or hurt them, the women told police.

“B’s like this get killed to be lying,” her friend told police that the victim said. They had talked about a mutual acquaintance in the neighborhood. She added he seemed “intoxicated” but didn’t threaten them.

Neither woman said she heard a shot. Davis’ relative said he slept through the incident in the basement.
