One of the brothers arrested in connection with a shooting on Flagstaff Road in May 2023 was sentenced Friday to 20 years in prison.

Jafet Hernandez-Gonzalez, 23, was initially charged with attempted first-degree murder — after deliberation, six counts of attempted first-degree murder — extreme indifference, attempted second-degree murder, first-degree assault — cause serious bodily injury with a deadly weapon, second-degree assault — cause injury with a deadly weapon and multiple violent crime enhancers, alongside his brother Josue Hernandez-Gonzalez.

On Oct. 2, Jafet Hernandez-Gonzalez pleaded guilty to attempted second-degree murder. Upon entering the plea, the remaining charges were dismissed.

In court on Friday, David Gomez Sr., the father of David Gomez, the victim who sustained serious bodily injuries in the shooting, requested that Hernandez-Gonzalez receive a maximum sentence of 20 years.

“I am the father of the individual that was shot … he was on life support, and they didn’t know if he was going to survive,” Gomez Sr. said. “The bullet that hit him severely damaged the main artery in his leg.”

Defense Attorney Mark Burton requested that Hernandez-Gonzalez receive a 10-year sentence, due to his age and minimal criminal history.

Hernandez-Gonzalez expressed remorse for what happened.

“I truly understand the consequences that this will have on my life and not just my life but my girlfriend’s life and my child’s life. … Just the fact that my whole family has been torn apart because of this. My brother is in (the youthful offender system),” said Hernandez-Gonzalez.

Boulder District Judge Thomas Mulvahill acknowledged the victims and their families before delivering the verdict.

“I understand that you are focusing on the impact it had on you and your family, but there are six families out there that were impacted by your senseless actions. Two people got shot, four people got shot at,” said Mulvahill. “David Gomez, he is still hurting from the wounds … I would say this — you’re not gonna like my sentence.”

Mulvahill sentenced Hernandez-Gonzalez to 20 years in prison with a three-year period of mandatory parole.

The shooting happened around 4:30 a.m. May 12, 2023, after one of the victims, an 18-year-old, was driving a Cadillac Escalade with a group of young adults when he crashed into a guardrail on Flagstaff Road, according to an affidavit.

In a second car, Jafet Hernandez-Gonzalez arrived to help before getting into a verbal confrontation with the driver of the Escalade, according to an affidavit. He drove away and got a gun before returning with his brother to the mountain road. By that time, other people had arrived to help those who were still in the Escalade.

Josue Hernandez-Gonzalez drove past the group twice before slowing down a third time, according to the affidavit. While passing, Jafet Hernandez-Gonzalez fired multiple rounds at the group — shooting the Escalade driver and another person.

Jafet’s brother Josue Hernandez-Gonzalez, 19, was sentenced in November to five years in the youthful offender system with a suspended 15-year prison sentence if he doesn’t comply.
