Carmel Unified School District board member Anne-Marie Lang Rosen is being charged with four felony counts of election fraud by Monterey County District Attorney Jeannine M. Pacioni’s office. Rosen is currently running for reelection in the district.

Rosen previously reported she resided in Trustee Area 4 which is not up for reelection this year. She is currently running to represent Trustee Area 5 and changed the address on her voter registration form to a residence in Area 5 in June, according to a news release sent out by the district attorney’s office Friday morning.

Rosen said Friday she is denying the charges and is seeking legal representation.

Police conducted a search of the two residences in Trustee Areas 4 and 5 which Rosen owns on Tuesday, following a search warrant directed by Judge Elisabeth K. Mineta of the Monterey County Superior Court. According to the DA press release, the search revealed Rosen resides in the Area 4 residence, not the residence in Trustee Area 5 which is a requirement for running for office in that area. Rosen says she splits time between the two residences.

Rosen declared in her candidacy paperwork in August that she meets “the statutory and constitutional qualifications for this office (including but not limited to, citizenship and residency).”

The District Attorney filed four counts of election fraud, alleging she filed a declaration of candidacy knowing at least part of the declaration was untrue, she registered as a voter in an area while knowing she was not entitled to registration and she knowingly falsified records for a public office in the state.

The district attorney’s charges have no legal effect on the election on Nov. 5, according to the news release. Rosen will remain on the ballot and is scheduled to be arraigned on Oct. 25.
