The Boulder Valley School District sued a contractor this week, accusing Albireo Energy of botching part of a 2023 job to update the air-control system at Angevine Middle School in Lafayette, which the district says resulted in nearly $1 million in damages.

Albireo, a subsidiary of Westover Corp., contracted with the district in early 2023 to convert temperature controls at 37 BVSD sites, including Angevine, and wrapped up work in May of that year, according to the complaint. In July 2023, “the District’s Facilities department became aware of an issue concerning excessive humidity and microbial growth located in several classrooms and portions of the corridors in the 600 wing at Angevine,” the lawsuit claims. “Upon arrival the following morning, District Facilities staff inspected the air handling unit that serves the affected area, and during that observation, discovered that the outside air damper for the unit was in the fully closed position while the pump for the evaporative section was running along with the supply fan for quite some time.”

Albireo’s “failure to conduct a review of the new programming upon the completion of the conversion to the new system to ensure proper operation” was a “major flaw” in the company’s execution of its contract with BVSD, the district said in its complaint.

BVSD “sustained at least $943,151.18 in damages including, but not limited to, costs to perform extensive remediation activities, along with the inconvenience and impairment of the educational process that the District sustained associated with the significant delays caused by the losses,” the lawsuit claims.

Albireo did not immediately respond to a request for comment Thursday.

The lawsuit is Boulder Valley School District No. RE-2 v. Westover Corp., case 2025CV30548, filed July 9 in Boulder District Court.
