A Warren cannabis cultivation business that was shuttered by the city last month due to safety violations was denied license reinstatement by the City Council Tuesday night.

DKB2 LLC, which is located at 32900 Dequindre Road near 14 Mile Road, was cited for non-compliant use of carbon dioxide (CO2) including improper ventilation last month on Aug. 26 and as a result, the city suspended the license for the facility.

“They are allowed to go into the building and tend to the plants, but they are not allowed to do anything else or conduct any business,” said Warren chief zoning inspector Everett Murphy.

Carbon dioxide is commonly used to grow cannabis as during photosynthesis, it increases a plant’s ability to produce energy which in turn can lead to larger and more abundant flowers.

The license for DKB2, which was issued on Oct. 12, 2023, specifies that CO2 enhancement is prohibited under the adult use growing establishment MRT MAP Class C license.

In a search warrant affidavit signed by Murphy and dated Aug. 26, Murphy states DKB2 does not have the proper ventilation system in place for the use of CO2 and that without proper ventilation, the use of CO2 in an enclosed building can cause serious health issues for people working in the building.

A letter sent to Warren City Council members and signed by Troy-based business attorney Joseph Thomas states the owners of DKB2 are willing to install the proper ventilation system in order to operate a CO2 system and requests lifting the license suspension for a limited period of time to enable his client to upgrade the ventilation system and bring it into compliance.

No representative of DKB2 was present at the Sept. 24 City Council meeting for the administrative hearing about the case. For that reason, the City Council denied the company’s appeal to reinstate the license.

Thomas could not immediately be reached for comment.
