



A man who was targeted in a wild, fatal shoot-out at his Ray Township home in 2022 is accused of leading police on a several-mile vehicle chase late last week before he was caught in possession of drugs.
Daniele Giannone, 39, was arraigned Tuesday in 41B District Court on charges of third-degree fleeing and eluding, two counts of possession of narcotics and resisting arrest for the incident that began in Harrison Township and ended in Chesterfield Township. All of the charges are low-level felonies
For a separate Jan. 26 incident in Macomb Township, Giannone was arraigned Monday in 41A District Court in Shelby Township on charges of failure to stop at a traffic accident, operating a motor vehicle without insurance and unlawful license plate registration, all misdemeanors. In that run-in, Giannone was driving on Hagen Road and failed to stop at a stop sign at Omo Road, causing another vehicle to strike his vehicle, sheriff’s officials said. Giannone allegedly fled the scene in his vehicle.
The recent incident began at about 3:15 a.m. Friday when a Macomb County Sheriff’s deputy saw a black BMW X5 cross the center line on Metropolitan Parkway near Interstate 94, according to sheriff’s officials. A deputy learned the driver had an outstanding warrant for operating a vehicle without insurance Jan. 7 in 42-I District Court in Romeo, officials said. Instead of stopping, Giannone allegedly drove away at a speed of over 60 mph on I-94, before exiting onto west bound M-59.
The deputy continued to pursue the suspect on Hall Road to Marketplace Boulevard, Gratiot Avenue, and Erb Drive in Chesterfield Township, according to officials. Giannone turned into a parking lot behind an industrial complex, where he exited and fled on foot. Two deputies chased and apprehended him.
Narcotics were found in his vehicle, officials said. His next appearance date was not provided in court records. For the incident in the Romeo court’s jurisdiction, Giannone faces an April 7 pretrial.
In July 2022, Giannone was the victim of an attempted murder at his North Avenue home by Matthew Mollicone, who was convicted of manslaughter, attempted murder and multiple felony firearm possessions last year following a jury trial in Macomb Circuit Court. Giannone was the key witness at the trial.
Giannone had an affair, which he claimed was over at that time, with Mollicone’s wife, Kimberly, who was killed when one of Giannone’s defensive shots at Matthew Mollicone hit Kimberly Mollicone, who reluctantly drove Mollicone to the home, where Mollicone initiated a shoot-out with Giannone. Giannone was shot in the leg during the incident.
Mollicone is serving a 12 to 40-year term in state prison.
Although the affair had ended years before, according to Giannone, investigators discovered that in the months prior to the incident about $60,000 of funds from the accounts of the Mollicone’s company, State Barricades, was transferred through more than a dozen transactions to Giannone’s accounts, which Giannone said were gifts from Kimberly.
Mollicone’s appellate attorney, Mark Kriger, filed a new-trial motion in circuit court on Mollicone’s behalf, according to court records. An evidentiary hearing on whether Mollicone’s defense attorneys were ineffective is scheduled for April 11 in front of Sabaugh.
Giannone’s lawsuit against Mollione and his wife’s estate is on hold pending the outcome of the new-trial request.
A lawsuit seeking over $24,000 from Giannone was filed against him last month in the Romeo court by BMW Financial Services, court records say.
