A 56-year-old Roseville man was sentenced as expected last week to 3-½ years in prison after pleading guilty to drug charges and a gun charge, in a case that went to the state Court of Appeals.
Anthony F. Maye received two years for felony firearm possession, one to five years for felon in possession of a firearm and 18 months for delivery or manufacture of less than 50 grams of cocaine from Macomb County Circuit Judge Michael Servitto. The two weapons charges are to be served concurrently and will run consecutive to the 18-month drug sentence. He received one day of jail credit.
A 30-year charge of possession with intent to deliver between 450 grams and 1,000 grams of cocaine was dismissed as part of a plea deal with Macomb prosecutors.
The drug term was the result of a sentencing agreement reached by Maye’s attorney, Steve Scharg, and the judge. The two-year sentence on the gun charge was mandatory by law.
Police said they confiscated 125 grams of cocaine and cash from Maye’s vehicle during an August 2019 traffic stop. In a search of his home, they seized 387 grams of cocaine, two digital scales with cocaine residue and four guns, one of which had been reported stolen.
Judge Alyia Hakim of 39th District Court in Roseville dismissed the 30-year charge due to questions over the validity of the searches but bound over the case on the lesser charges.
The refiling of the 30-year charge by Macomb prosecutors was upheld by the state COA in a 2022 precedent-setting ruling, saying Maye could be recharged because Hakim dismissed the charge “without prejudice.”
The most severe was reinstated but then dismissed as part of the deal to resolve the case.
Maye was convicted by plea of possession of less than 25 grams of a controlled substance in Wayne County Circuit Court and was sentenced to three years probation.
