A Frederick man arrested in late August for reportedly dealing psilocybin mushrooms to a teen who later died in a construction site fall is facing 40 additional criminal charges involving the distribution of drugs to minors and child sexual assault following a grand jury investigation.

Benjamin Charles Harmon, 24, was indicted on 16 counts of distributing a controlled substance to a minor, sexual assault of a child by someone in a positon of trust — pattern, sexual exploitation of a child — induce or entice, 16 counts of contributing to the delinquency of a minor, money laundering, two counts of controlled substance in a school or housing by a special offender, distribution of a controlled substance, possession of a controlled substance and attempt to distribute a controlled substance to a minor.

He is set for a status conference on Feb. 3 and is being held in custody on a $2,000,000 bond.

In his first case, Harmon is accused of selling psilocybin mushrooms that were used by a 15-year-old prior to his fatal fall from a Boulder construction crane on June 20. According to the Boulder County Coroner’s Office, the teen died on June 20 after falling 145 feet from a crane on a construction site at the Limelight Conference Center and Hotel, at the northeast corner of Broadway and University Avenue.

The autopsy found that the teen had psilocybin — a substance found in psychedelic mushrooms — in his blood.

Investigators later learned that the teen had purchased mushrooms on June 8 from Harmon in North Boulder Park.

On June 20, the boy and his friends, while at residence, ate the mushrooms that were reported to cause auditory and visual hallucinations, according to the affidavit.Police learned from a witness that a Snapchat user had provided drugs to the teen and after issuing a search warrant on the user’s account, they identified the suspect as Harmon.

The affidavit stated that Harmon was reportedly communicating with multiple Snapchat users about selling alcohol, nicotine, marijuana, mushrooms and acid and that he sold drugs to people in Boulder, Frederick, Broomfield, Superior and Thornton.

An undercover agent then used a Snapchat account to contact Harmon and set up a drug deal at North Boulder Park on Aug. 7 for mushrooms.

Harmon agreed and sent a picture to the agent via Snapchat when he arrived at the park.

Officers then contacted him and he was taken into custody.

According to a release, investigators later identified at least 19 other child victims to whom Harmon reportedly “distributed drugs, including one who Benjamin Harmon sexually assaulted at gun point, and one from whom Benjamin Harmon obtained child sexual abuse materials.”

In an interview with police, the victim said she met with Harmon a number of times while trying to buy marijuana from him. During her third visit to Harmon’s home on Sept. 9 — while Harmon was out on bond following his first arrest — the teen said Harmon took a gun from a safe, pointed it at her torso and told her to “get undressed” before sexually assaulting her.

From May 15 through Aug. 7, Harmon was also reportedly in possession of 13 sexually explicit images and videos of an underage girl.

The Boulder County Sheriff’s Office said all the students listed as victims are high school students in Boulder County and that their parents have been notified of the investigation and prosecution.
