A Lockport Township High School science teacher Tuesday pleaded not guilty to attempting to distribute nude photos of his former girlfriend.

Stephen Soderborg, 28, of Mokena, was charged earlier this month with attempted non-consensual dissemination of private sexual images. If convicted, Soderborg faces a minimum of court supervision and a maximum sentence of one year in prison.

Soderborg was charged under an Illinois law adopted in 2015 that makes alleged “revenge porn” — or the posting of sexual images of a former partner without that person's consent — a class 4 felony. But Soderborg faces misdemeanor charges because the offense was charged as an “attempt.”

“The facts of this case are not going to lead to revenge porn,” Soderborg's attorney, Jeff Tomczak said Tuesday.

A spokeswoman for Lockport Township High School Tuesday said Soderborg is employed by the district and began teaching in the district in 2012. She declined further comment noting there is an ongoing investigation.

According to court documents, Soderborg allegedly posted online an image of his former girlfriend exposing nude portions of her body.

Will County Sheriff's Department spokeswoman Kathy Hoffmeyer said investigators first received a complaint from Soderborg's former girlfriend in December 2015. She claimed Soderborg posted various images of her online that summer. Hoffmeyer said Soderborg told investigators he had taken the images down shortly after posting them.

“They were breaking up and he was upset,” she said. “Once he did it, he realized that he should not have (done that).”

Investigators were able to retrieve at least one of the images, Hoffmeyer said. The yearlong investigation included reviewing Soderborg's cellphone and laptop as well as determining if the offense fit under the new law, Hoffmeyer said.

Tomczak said he plans to file a challenge to the new law claiming it is vague and that the claim to privacy between two consenting adults does not exist when a photo is taken.

“We are going to vigorously defend Mr. Soderborg on this matter,” Tomczak said. “This matter, I think, is going to turn out to be a very different case than it appears on its face.”

Soderborg is scheduled to appear again in Will County court Feb. 21.
