Boulder officials have officially greenlit new regulations for natural medicine businesses where adults 21 and older can legally use certain psychedelic substances under supervision. The state began issuing natural medicine business licenses at the beginning of this year.
Psilocybin and psilocin, both found in psychedelic mushrooms, will be the first two substances allowed at these businesses. Dimethyltryptamine (DMT), ibogaine, and mescaline are legal for personal use statewide, but they’re not expected to be allowed at licensed facilities until 2026.
These substances are still illegal at the federal level.
Going forward, natural medicine “healing centers” in Boulder will be regulated similarly to medical offices, and cultivation, production, and testing facilities will be considered light manufacturing uses.
Natural medicine businesses will be allowed in residential areas, but they must be located at least 500 feet from middle and high schools. Councilmember Tina Marquis had proposed requiring the businesses to be at least 500 feet from elementary, middle and high schools, but a majority of council members didn’t agree with her suggestion.
City Council members approved the new rules on Thursday night on an 8-1 vote. Marquis was the lone “no” vote.
