An Oak Park man accused of murdering a DoorDash driver is scheduled to have a preliminary exam next month where a judge will be presented with evidence on the case and decide if it should proceed.
Terrell Simms, 39, is facing criminal charges for the March 9 fatal shooting of Mamadou Diallo, 26, in Ferndale. Investigators said it’s believed to be a road rage incident turned deadly on Woodward Avenue just north of Eight Mile Road.
The preliminary exam is scheduled for May 8 before 43rd District Judge Joseph Longo who will determine whether there’s probable cause for the case to advance to Oakland County Circuit Court for possible trial. Ferndale police investigators determined that shortly before the reported shooting, Diallo had picked up a DoorDash order from the White Castle restaurant at 21400 Woodward Ave. He then merged onto northbound Woodward Avenue, entered a turnaround to head south and then merged onto southbound Woodward where a GMC truck speeding recklessly nearly collided with Diallo’s car before abruptly switching lanes, police said. At Eight Mile Road, the GMC truck driver slowed down, waited for Diallo to catch up and, investigators believe, fired six gunshots at Diallo’s car in an apparent road rage incident.
Officers found Diallo lying near his Ford Escape, shot in the torso. He was transported to a nearby hospital where he was pronounced dead.
Diallo, originally from Senegal, was living in Detroit at the time, according to Ferndale police.
Simms is charged with second-degree homicide and three firearms-related offenses. He’s held in the Oakland County Jail.
