The district attorney’s office did not file charges against two security guards who shot and killed an armed Hesperia man in a parking lot near the Santa Fe Springs swap meet on July 21, authorities confirmed.
The guards fired only when Christopher Farias Ortiz accelerated quickly toward a guard standing in front of his car, Deputy District Attorney Maren F. Dermody wrote in an Aug. 6 form outlining why the case was rejected.“Both suspects have self-defense and/or defense of other claims,” the lawyer wrote. “As such, the case cannot be proved beyond a reasonable doubt and is declined.”
The guards had responded to a fight involving two groups of men in a parking lot on Mica Street. During the fight, Ortiz, 28, drove up in a white Cadillac sedan and got out with a gun in his right hand, the prosecutor said.
Ortiz can be seen kicking and punching a man in a video and then being shoved to the ground, she wrote. At one point, he fired a round into the asphalt in the direction of another person.
Ortiz got back into his car. One security guard stood in front of the sedan with his gun drawn in an attempt to prevent Ortiz from fleeing, Dermody wrote.
The other security guard also had his gun drawn and stood 4 to 5 feet away from the driver’s side window.
Ortiz attempted to slowly drive forward but was blocked by the guard standing in front of the car, the prosecutor said. He suddenly accelerated toward the guard, making contact, she wrote. Both guards started shooting.
Ortiz was hit three times and died at the scene.
Whittier police said the fight was gang-related and later arrested a Los Angeles man on suspicion of assault with a deadly weapon.
